Can I just fill in my swale?

Answer

The primary functions of a swales are to capture the runoff from the roadway and the adjacent properties and give it a path to an outfall such as a ditch or basin. If the swales were filled in the runoff would have nowhere to go other than into the roadway and onto the adjacent properties making it dangerous to drive on the road and possibly threatening to get into your home.
